Elite Class Limo Group LLC, enables users to book transportation services via its online platform, mobile applications, and other integrated third-party platforms (collectively referred to as “EC-LG Tools”). EC-LG’s service consists of arranging transportation provided by independent ride service providers (Transportation Service Providers or “TSPs”). EC-LG facilitates these arrangements but does not provide the actual transportation service.
These General Terms and Conditions (“T&Cs”) form an integral part of any agreement between the user and EC-LG concerning the arrangement of transportation services. They also define the user’s direct claim against the TSP for transportation services arranged by EC-LG.
Conflicting terms from the user are hereby excluded unless explicitly agreed upon in writing by EC-LG’s management.
Contractual Relationship: EC-LG does not directly provide transportation services. Instead, it facilitates the user’s claim for transport against an independent TSP.
To do this, EC-LG enters into agreements with TSPs on behalf of the user, creating a transportation contract for the user’s benefit. This allows the user to request and receive transportation services directly from the TSP.
The agreement between EC-LG and the user pertains solely to the arrangement of transportation services and not the transportation itself. Compensation to EC-LG includes fees for arranging the service and for the transportation provided by the TSP.
Conclusion of Contract: By submitting a completed booking form via EC-LG Tools or by making arrangements over the phone, the user offers to enter into a business service contract (“ride request”). The contract covers the provision of the requested ride service.
Upon receipt of a ride request, EC-LG sends an email confirmation detailing the request. This email is not a booking confirmation but merely an acknowledgment of the request.
A business service contract is concluded only upon EC-LG sending a separate booking confirmation via email. The user then has a direct claim against the TSP to request and receive the ride service.
Registration Obligation of the User for the Use of the EC-LG Tools: The user must ensure that all information provided to EC-LG is complete and accurate. Automated registrations are prohibited.
Selected Content of the Transportation Contract for the Benefit of the User: The user can request ride details as agreed in the business service contract. The following conditions apply to the user’s direct claims against the TSP arranged by EC-LG:
Ride Types, Service Changes: Depending on availability, users can choose from transfer rides, long-distance rides (over 200 km), rides on demand, and hourly bookings.
Additional costs may apply if the actual ride involves more effort than initially requested. Users may request changes to the ride even after the contract conclusion, subject to additional charges.
Pickup Time: The agreed pickup time is specified in the booking confirmation. For airport or train station pickups, EC-LG adjusts the pickup time if there are delays in the user’s flight or train arrival.
Vehicle Class/Model, Upgrade: Users can select different vehicle classes during booking. Specific vehicle models are not guaranteed. EC-LG may upgrade the vehicle class at no additional cost based on availability.
Luggage, Animals: The booking confirmation includes the number of luggage pieces specified. Excess or bulky luggage, weapons, or animals must be disclosed during booking. TSPs may refuse to transport undisclosed items.
Transport of Children and Minors: Users must specify the need for child restraints in the ride request. TSPs may reject unaccompanied minors according to local laws.
Information on Number of Passengers, Luggage: The TSP may refuse transport if the number of passengers or luggage exceeds the vehicle’s capacity and safety conditions.
Impeded Transport: If transport is not possible due to non-compliance with mandatory requirements, EC-LG is still entitled to compensation from the user.
Delays: Users must accept longer waiting times or short-notice cancellations in exceptional situations like strikes or inclement weather.
Cancellation: For transfer rides, long-distance rides, and hourly bookings, cancellations are free if made more than one hour before the pickup time. If the cancellation is made within one hour of the pickup time, the full price must be paid. Cancellations can only be made through the EC-LG Tools.
Rebookings: Rebookings are treated as new bookings. The cancellation policy applies to the original booking.
No-Show Rides Without Cancellation, User’s Delay: A ride is considered a no-show if the user does not appear within 30 minutes of the pickup time, or within 60 minutes for airport/train station pickups. No-show rides are fully compensated, excluding waiting time surcharges.
Behavior in the Limousine: Users must comply with road traffic rules and TSP instructions during the ride. Opening doors, throwing objects, or shouting from the vehicle is prohibited. Smoking and food consumption in the vehicle are not allowed without prior permission. Alcoholic drinks require prior consent.
General Principles: The booking confirmation specifies the remuneration due to EC-LG, including ride service expenses. Factors include vehicle class, route, booking lead time, and pickup details. Special requests may increase the price.
Ride Changes: Users can request changes after the contract conclusion, subject to additional costs. Any reductions in distance or hours do not affect the agreed compensation.
Waiting Times for Transfer Rides: No surcharges apply for waiting times up to 60 minutes for airport/train station pickups and 15 minutes for other pickups. Additional waiting time is invoiced per minute.
Additional Kilometers for Hourly Bookings: Hourly bookings include specific kilometers. Extra kilometers are invoiced separately.
Payment Modalities and Transaction Fees: Users can pay by credit card, with any credit card fees borne by EC-LG. Bank transfer payments may incur transaction fees borne by the user.
Warning Notices, Failed Credit Card Debiting: EC-LG may charge a reminder fee for each payment warning notice and invoice expenses for failed credit card debits.
Transmission of Invoices, Due Date: Invoices are available for download in the user account. Credit card payments are due immediately; bank transfers are due per the invoice terms.
Vouchers: Vouchers are one-time use, not combinable with others, and not redeemable for cash.
General Principles: EC-LG is liable for damages caused by its actions or gross negligence. TSPs are not EC-LG’s agents for transportation services. EC-LG’s liability for simple negligence is limited to foreseeable damages from material contractual obligations.
Content of EC-LG Tools: EC-LG is not liable for errors or damages from free content or programs. This includes errors, delays, interruptions, technical issues, data loss, and virus infections.
Third-Party Websites: EC-LG is not responsible for the content, legality, or functionality of linked third-party websites.
Correctness of Transmitted Information, Access Disruptions: EC-LG is not liable for transmission errors or disruptions beyond its control. This includes force majeure events and communication network failures.
Indemnity from the User: Users indemnify EC-LG for claims and costs from non-contractual use of EC-LG Tools or violations of these T&Cs.
Objects Left Behind: No liability is assumed for forgotten items in the vehicle.
Amendment of EC-LG’s Offer: EC-LG reserves the right to change EC-LG Tools for quality improvement or terminate offers for material reasons.
Protection of Content, Rights of Use to EC-LG Tools: Content on EC-LG Tools is protected by copyright. Users have a revocable right to use EC-LG Tools for intended purposes, with no further rights granted.
Whole Agreement, Written Form: These T&Cs constitute the entire agreement between EC-LG and the user. Amendments must be in writing.
Offset, Retention, and Assignment: Users can only set off claims against EC-LG if legally established or undisputed. Retention rights are limited to the same contractual relationship. Claims cannot be assigned without EC-LG’s consent.
Applicable Law, Jurisdiction: The law of the State of [State] applies. The place of fulfillment and exclusive jurisdiction is [City], unless otherwise required by law.
Online Dispute Resolution: The EU Commission’s OS platform for online dispute resolution can be accessed at our contact page. EC-LG does not participate in dispute resolution before a consumer arbitration board.
Severability Clause: If any provision of these T&Cs is invalid, the remaining provisions remain effective. Invalid provisions will be replaced with ones that closely approximate the intended meaning and purpose.
